This book constitutes the refereed proceedings of the 20th International Conference on Formal Engineering Methods, ICFEM 2018, held in Gold Coast, QLD, Australia, in November 2018. The 22 revised full papers presented together with 14 short papers were carefully reviewed and selected from 66 submissions. The conference focuses on all areas related to formal engineering methods, such as verification; network systems; type theory; theorem proving; logic and semantics; refinement and transition systems; and emerging applications of formal methods.

Die Wirtschaft der Volksrepublik China befindet sich in der Umwandlungsphase von der Planwirtschaft zur Marktwirtschaft, was zur Entwicklung eines öffentlichen Auftragswesens geführt hat. Der Staat sieht sich dabei Herausforderungen wie Korruption und wirtschaftlichen Fehlentscheidungen gegenüber, weshalb ein effektiver Rechtsschutz von großer Bedeutung ist. Das aktuelle chinesische Vergaberecht bietet benachteiligten Bietern eine zweistufige Verwaltungskontrolle für Primärrechtsschutz, jedoch ist der Rechtsschutz unzureichend. Im Gegensatz dazu hat sich das deutsche Vergaberecht, beeinflusst durch europäisches Recht, vom haushaltsrechtlichen Innenrecht zu einem bieterschützenden wettbewerbsrechtlichen Außenrecht gewandelt. Die Arbeit vergleicht den chinesischen Begriff „Zhengfu caigou“ mit dem deutschen „Vergabe öffentlicher Aufträge“ und analysiert das materielle Vergaberecht in beiden Ländern. Sie untersucht zudem die Nachprüfungsbehörden, -verfahren und gerichtlichen Rechtsbehelfe und prüft die Übertragbarkeit deutscher Regelungen auf das chinesische Recht. Auf Basis der deutschen Erfahrungen und des bestehenden chinesischen Bieterschutzsystems wird ein Konzept für die Nachprüfungsverfahren in China entwickelt.
