Spätestens seit den Diskussionen der 1980er Jahre um einen "Justizkonflikt" herrscht gegenüber dem US-amerikanischen Rechtssystem aus deutscher Sicht eine gewisse, unverändert gebliebene Skepsis. Dieser Skepsis nähert sich die Untersuchung über die Frage der Anerkennungsfähigkeit US-amerikanischer Entscheidungen in Deutschland.
