The paper analyzes the limitations of the current European directive on data protection concerning the exercise of the right to informational self-determination in cloud computing involving subcontractor chains. It specifically examines the personal and geographical scope of data protection, as well as the legitimacy of data processing, particularly regarding data transmission to secure and unsecure third countries with subcontractor involvement. A critical assessment is made of whether the existing options for processing personal data provide adequate privacy security in cloud environments. The effectiveness and implications of legitimizing personal data processing in cloud computing are also explored, including the inclusion of subcontractors in complex cloud landscapes across various countries. The positions and opportunities for data subjects and cloud users to assert their rights of informational self-determination in distributed cloud environments are scrutinized. Given the challenges personal data faces in these complex landscapes, the paper highlights the need for improvements aimed at mitigating risks to data subjects' rights. Lastly, it cross-examines the recent regulation on general data protection published by the Council on June 11, 2015, against the identified gaps in the existing directive, focusing on the requirements for achieving informational self-determination.
