      Regulatory reforms and the quality of legislation are nowadays important issues discussed among legal scholars, legislative lawyers and politicians. In many countries and also at the level of the European Union efforts are made to improve regulations and to introduce new standards or to strengthen existing good practices. Reforms include substantial aspects (content of norms or public policies) as well as procedural or institutional aspects and the techniques and forms of regulation. This publication contains contributions from the point of view of different countries and legal systems. Special focus is given on the situation in Russia where regulatory reforms meet particular challenges because the current context in many regards differs fundamentally from the Soviet past. The political, institutional, economic, technical and territorial conditions are indeed hardly comparable and require more profound and comprehensive changes than in most other countries. Furthermore, the contributions highlight the fact that reforms have to be implemented; it is not enough to merely decide them.

      This publication presents the proceedings of the 9th Congress of the International Association of Legislation (IAL), which took place in Lisbon on 24/25 June 2010, organized by the School of Law, New University of Lisbon. The IAL develops the study of theoretical and practical approaches to legislation and promotes the cooperation between different countries in the area of lawmaking. The general topic of the Congress was the quality of legislation. The published papers debate the following issues: the essential content of quality of legislation; how legislative procedure can contribute to favour quality; which is the role of regulatory impact assessment; how can an optimal accessibility to legislation be realised. This publication also includes the abstracts of all posters presented during the Congress. Furthermore, 25 papers of some of the most renowned experts on legislative studies, which will certainly give a valuable contribution to the enlargement of the debate on legisprudence, or more broadly to all efforts to improve legislative quality, are included. So far, Nomos has published all previous IAL Congresses’ proceedings, which allows an interesting approach of the developments, at EU level and at different countries, on the regulatory policy.

      Gesetzestechnik und Rechtskultur sind stark geprägt von spezifischen nationalen Traditionen und Institutionen. Dies ist zwar auch heute noch so, aber es lässt sich nicht verkennen, dass der Prozess der europäischen Integration die Gesetzgebungspraxis in Europa tiefgreifend verändert. In besonderem Maß gilt dies für Staaten, die der Europäischen Union erst in den letzten Jahren beigetreten sind und die ihr nationales Recht rasch und umfassend an das Recht der EU anpassen mussten. Wie gehen Praxis und Wissenschaft mit diesen Veränderungen um? Wieweit ist es möglich, nationale Rechtskulturen in diesem Prozess zu bewahren? Entwickelt sich eine gemeinsame europäische Gesetzestechnik? Was bedeutet das für die Qualität der Gesetzgebung, die nicht zuletzt auch ein wichtiges Anliegen der EU ist? Die Beiträge für den 8. Kongress der European Association of Legislation gehen diesen Fragen nach. Sie machen die praktischen Schwierigkeiten deutlich, die sich aus der gegenseitigen Durchdringung unterschiedlicher gesetzestechnischer Ansätze, Sprachen und Rechtskulturen ergeben. Gleichzeitig zeigen sie auf, wie den damit verbundenen Herausforderungen begegnet werden kann. Damit leisten sie einen wichtigen Beitrag für Praktiker und Wissenschafter, die sich mit der Entwicklung der Gesetzgebung in Europa befassen.
