    Sir Henry James Sumner Maine è stato un giurista e storico comparatista inglese. È famoso per la tesi esposta in "Ancient Law" secondo cui il diritto e la società si sono evoluti "dallo status al contratto". Secondo la tesi, nel mondo antico gli individui erano strettamente legati dallo status a gruppi tradizionali, mentre nel mondo moderno, in cui gli individui sono visti come agenti autonomi, sono liberi di stipulare contratti e formare associazioni con chiunque scelgano. Grazie a questa tesi, Maine può essere considerato uno dei padri fondatori della moderna sociologia del diritto.
