Il realismo scandinavo è una concezione positivistica, ma distinta dal positivismo continentale. D'altra parte, anche se porta il nome e usa il metodo dei realisti americani, si muove in direzione diversa: là dove il realismo americano, per dissolvere le concezioni tradizionali del diritto, finisce per dissolvere il diritto stesso in concezioni socilogiche o paragiuridiche, il realismo scandinavo adatta, lima, raggiusta, per trasformarsi infine in crogiuolo delle dottrine tanto americane quanto europee, continentali o scandinave.
