This book describes law from the perspective of its language. It expands, reformulates and reshapes the author’s previous book «Legal Linguistics». The recomposed text corresponds to lectures held for students of legal linguistics and scholars interested in the fundamental legal-linguistic research. The author focuses on legal-linguistic operations such as legal argumentation and legal interpretation that steer the legal discourse. He also explains the processes in which the meaning of law emerges in discursive practices. Furthermore, he scrutinizes problems of textuality of law. This book is also an introduction into the law of linguistic communication and into legal futurology that comprises linguistic aspects of legal globalization.

The book approaches law from the legal-linguistic perspective. Its aim is to clarify the processes in which the meaning of law emerges in legal discourses. In order to enable the understanding of law as a discursive practice, professional and non-professional discourses are analyzed. With this aim in mind, the author focuses on the epistemological consequences of the discursiveness of law. Other relevant legal-linguistic operations such as legal interpretation or legal translation are scrutinized in terms of their theoretical prerequisites and their practical consequences. Their analysis also shows the potential and the limits of law as a social and as a linguistic phenomenon that is determined by its discursiveness. Finally, the book demonstrates how the discursiveness as the distinctive feature of law establishes the connection between the science of law and other social sciences.

This book introduces into the problems of Legal Linguistics. It starts with the most fundamental legal-linguistic question, i. e. how law is created and applied with linguistic means. In breaking down this vast question, the book identifies the linguistically relevant aspects of language use, especially its terminology, and scrutinizes the most significant legal-linguistic operations such as the legal argumentation, the legal interpretation, and the legal translation. Based on case analyses, it canvasses the language use strategies that are most instrumental in the developing of professionally convincing legal argumentation, primarily around terminological units. Towards the background of these and other linguistic operations in law, the book reflects upon some practical problems related to the regulation of language use and the emergence of the global law.

In der Arbeit wird die finnische Rechtstheorie und ihr Einfluß auf die Entwicklung der finnischen Rechtswissenschaft untersucht. Der Schwerpunkt der Untersuchung liegt in der Analyse der Ergebnisse der finnischen Rechtstheorie der 80er Jahre, wobei jedoch auch ihr ideengeschichtlicher Hintergrund und ihre Hauptströmungen, nämlich die analytische, die hermeneutische und die marxistische, besprochen werden. Ausgehend von diesem Theoriespektrum wird die Frage nach dem Paradigmenwechsel in der gegenwärtigen finnischen Rechtstheorie und nach ihrem Einfluß auf die finnische Rechtsdogmatik gestellt.

Der Schwerpunkt der Begründungsprobleme der Södergran-Philologie liegt einerseits darin, zu zeigen, welche methodischen Probleme sich der bisherigen Södergran-Philologie bei der Begründung ihrer Ergebnisse stellen, andererseits einen neuen Versuch zu unternehmen, der Södergran-Philologie neue inhaltliche Ergebnisse zukommen zu lassen. Die Arbeit behandelt daher: die Probleme der Argumentation von Tideström bis Schoolfield, die Dichtung Södergrans, insbesondere die Metaphysik ihres Werkes, die Problematik des freien Verses, das Problem des Todes als literarisches Problem und die allgemeine Struktur des Werkes Södergrans. Ferner werden die Stellung Edith Södergrans innerhalb der finnlandschwedischen Literatur und das Rezeptionsproblem des Werkes Södergrans im Zeitpunkt ihres Debuts und heute behandelt.
