As the world becomes more digitalized, new business models and forms of labor are emerging, particularly through crowdsourcing and crowdworking, which encompass a global labor market. The working conditions in this sector significantly impact established employees, competition among crowdworkers, and the sustainability of social security systems. While it is premature to provide a final assessment of this evolving workplace, it is evident that it will influence the labor market and legal institutions. In response, the HSI has examined the factual and legal developments brought about by crowdsourcing in three major legal landscapes, enlisting three esteemed legal experts for this task. The findings of this study serve as a preliminary evaluation of the dynamic changes within the platform economy. Crowdworkers operate under various arrangements, leading to diverse employment scenarios—some resembling employees, others self-employed contractors, and many falling in between. However, most crowdworkers lack social protections. This study presents a range of legislative options that could help address these gaps across different legal systems, highlighting the need for improved protections for this emerging workforce.
